YOVEO / PRODUCT “IREWIND”

Yoveo AG (YOVEO, we, us or our) provides with its product “iRewind” (iRewind) a solution allowing sport practitioners and visitors of leisure locations to enjoy a video memory of their experience. Participants in iRewind enabled events or locations are identified using radio-frequency tags and are filmed by iRewind cameras installed in certain areas (filmed areas). Users can subsequently access their personal videos on the iRewind website (www.irewind.com) and the iRewind mobile applications.

SCOPE OF APPLICATION

This privacy policy (the Policy) applies to you (the User, you and your) if you visit our website, download or use our app or any other of our services (collectively, the Service). It describes how we and some of our trusted partners collect, use and disclose your protected personal data in relation to our service. Protected personal data means any information that you provide to us which personally identifies you, such as your name, email address, billing information or your image appearing on the video that you shoot with iRewind app or other data which can be reasonably linked to such information (the personal data). This policy also describes your rights to access and control your personal data.

By using our product iRewind you agree to the collection and use of your personal data in accordance with this policy.

WHAT INFORMATION IS COLLECTED

Personal data you provide us

  • Your username, password and e-mail address when you register for an iRewind account.
  • Profile information that you provide for your user profile (e.g., first and last name, picture, phone number).
  • Your image appearing in the movies shot with iRewind app, and any other photos, comments and other materials you post to the service.
  • Communications between you and YOVEO. For example, we may send you service-related emails (e.g., account verification, changes/updates to features of the Service, technical and security notices).

Location information

iRewind app generally requires that we will collect and process data from your mobile device to determine your actual location, such as GPS signals sent by your mobile device.

  • Log information (e.g. pages viewed, access times, IP address, HTTP headers)
  • Data collected via cookies

We may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use the service and provide features to you.

We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by us or the third party.

As a general rule, your personal data we processed is collected by YOVEO or any company of YOVEO group operating the iRewind app.

WHERE WE STORE YOUR PERSONAL DATA

As a general rule, we process and store your personal data in our own servers in Switzerland or in the servers we installed near the site where you shoot the video. We may also use a cloud-based solution implying that your personal data will be processed and stored on the servers of our cloud service providers, which may be located in many countries around the world. You hereby expressly agree and consent that your personal data may be processed and stored on servers located outside the country where you live, including in a country that does not have the same data protection laws as your jurisdiction.

HOW WE USE YOUR PERSONAL DATA

In addition to some of the specific uses of information we describe in this policy, we may use information that we collect to:

  • provide, maintain, protect and improve the service, to develop new services and to protect us and our other users;
  • remember information so you will not have to re-enter it during your visit or the next time you visit our website or use iRewind app;
  • offer tailored content, which could include online ads or other forms of marketing;
  • monitor metrics such as total number of visitors, traffic, and demographic patterns;
  • diagnose or fix any technology you may be facing;
  • automatically update the iRewind app on your device;
  • we may use your e-mail address to send you our newsletter or provides you with some news relating to our service, such as letting you know about upcoming changes or improvements. You may at all time unsubscribe from our newsletter by sending an e-mail to our data controller (info@yoveo.com);
  • to serve ads when you visit the service via third parties companies. These companies may use information (not including your name, address, email address, or telephone number) about your visits to our website and other websites in order to provide you with relevant advertisements.

Unless provided otherwise herein, YOVEO will not share your personal data with third parties.

YOVEO may notably share your personal data as follows:

  • YOVEO may share your personal data to service providers (e.g. payment processors, cloud provider). Our service providers will be given access to your personal data as is reasonably necessary to provide the service under reasonable confidential terms.
  • YOVEO may share your personal data. For instance, we may cooperate with an event organizer and agree that your videos are posted on a dedicated website operated by the event organizer, so that you may easily access to your videos via this website. We will make sure that these event organizers commit to comply with the terms of this policy.
  • YOVEO may share your personal data (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with other companies of YOVEO group (the affiliates ). Affiliates may use this information to the same extent that we can. But we will make sure that these affiliates commit to comply with this policy.
  • We may also share certain information such as cookie data with third-party advertising partners. This information would allow third-party advertising networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.
  • If it is required under law to do so or we reasonably believe that such release is necessary to comply with applicable legislation or respond to a court in order or to protect YOVEO’s rights and interests.
  • We may also share aggregated, non-personally identifiable information with any of our partners – like advertisers, connected sites, business partners, etc. For instance, we may gather and analyze data on your performance (e.g. the number of turns in a ski descent) and compile such data with similar data of other Users and provide and sell such data to a business partner (e.g. a ski manufacturer).
  • If YOVEO is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal data and give affected users notice before personal data is transferred or becomes subject to a different privacy policy.

HOW LONG WE STORE YOUR PERSONAL DATA

As a rule, videos might be stored and available to you for an unlimited period. Other personal data (such as cookie, etc.) is stored for 6 months. We further reserve the right to retain for an unlimited period of time information derived from your personal data in such a way that you will no longer be identified or identifiable (anonymized data).

SECURITY

We use commercially reasonable safeguards to help keep the information collected through the service secure and take reasonable steps to verify your identity before granting you access to your account. However, YOVEO cannot ensure the security of any information you transmit to YOVEO or guarantee that information on the service may not be accessed, disclosed, altered, or destroyed.

ACCESS TO AND MODIFICATION OF PERSONAL DATA

Whenever you use the service, we aim to provide you with access to your personal data we control. If that information is wrong, we strive to give you ways to update it quickly or to delete or to anonymize it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal data, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical.

We may revise this Policy from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you. By continuing to access or use the service after revisions become effective, you agree to be bound by the revised policy. If you do not agree to the new policy, please stop using iRewind.
